Kannapolis woman owes insurance company after settling personal injury case – WSOC TV


KANNAPOLIS, NC – An Action 9 investigation revealed something you may not know about your health insurance company.

Joy Haynes said she was in a restaurant when a waiter spilled a hot drink on her, burning it. She went to emergency care for treatment and said it cost her around $ 300, which she paid out of pocket.

Haynes told Action 9’s Jason Stoogenke that the restaurant’s insurance took responsibility and reimbursed her for the trip to emergency care. He also made her sign a form agreeing that she would not try to get more money from the business later. Haynes said she had no problem with the deal, so she signed the form.

Haynes told Stoogenke that she forgot about the incident until more than two years later, when she received a letter from her health insurance company, the State Health Plan.

The State Health Plan said he spent $ 600 on his emergency care visit and the restaurant’s insurance should have reimbursed the company, but since Haynes signed the settlement form, she was now responsible to pay $ 600.

“The last thing I thought about was having an extra $ 600 to pay for something that happened two years ago,” she told Stoogenke. “I didn’t know it was my responsibility to take care of their problem as well, making sure they were paid for the services they rendered to me.”

Blue Cross and Blue Shield, who run the state’s health plan, told Stoogenke they are suing people in cases like this to cut health care costs. Other insurers have similar practices.

Haynes said she contacted the restaurant’s insurance company and after all this time she still agreed to reimburse her health insurance company so she didn’t have to.

Stoogenke said it’s important to know your insurance policy. If the other party’s insurance reimburses you for your medical expenses, make sure they reimburse your health insurance company as well. Don’t sign a settlement or anything that says they’re doing business with the other insurance company until you know your health insurer is happy.
