La. Plantation loses bid for commercial COVID-19 coverage

By Elizabeth Daley (August 22, 2022, 7:55 p.m. EDT) – A federal judge in Louisiana has denied the historic plantation where “Mandingo” was filmed a cover of Westchester Surplus Lines Insurance Co. for hundreds of thousands of dollars in cases pandemic-related losses, citing previous cases preventing similar coverage.

U.S. Senior District Judge Ivan LR Lemelle wrote in his order Wednesday that “aside from one state appellate court decision, the case law applying Louisiana law is consistent: the COVID-19 does not present direct physical loss or damage in such a way as to trigger insurance policy provisions for lost business necessary additional income or expense.”
